Definitions: Games, movies, and content produced by POWWOW MEDIA (ADVERTISING SA) shall be known as the SOFTWARE.

You should carefully read the following terms and conditions before using this SOFTWARE. Unless you have a different license agreement signed by POWWOW MEDIA (ADVERTISING SA), your use or distribution of this SOFTWARE indicates your acceptance of this license agreement and warranty.

Use of the SOFTWARE is contingent on your agreement to the following terms:

GRANT OF LICENSE

The SOFTWARE may not be used on sites that are pornographic, hate related, racist, or sites that install adware or other types of sites that POWWOW MEDIA (ADVERTISING SA) in it's sole discretion sees as being unsuitable. POWWOW MEDIA (ADVERTISING SA) may also at its sole discretion exclude websites or companies from software licenses. If you are using the SOFTWARE on a website and you are notified by POWWOW MEDIA (ADVERTISING SA) to remove it you agree to do so immediately. YOU ARE NOT ALLOWED TO PACKAGE THE SOFTWARE WITH YOUR SOFTWARE OR OTHER 3RD PARTY SOFTWARE, OR REQUIRE OR ENCOURAGE USERS TO DOWNLOAD OTHER SOFTWARE. The license terms may be changed at any time and are available to see on the POWWOW MEDIA (ADVERTISING SA) website at www.powwow.net.au/terms-and-conditions.html.

This SOFTWARE is protected by copyright laws and international copyright treaties, as well as other intellectual property laws and treaties.

MAINTENANCE

POWWOW MEDIA (ADVERTISING SA) is not obligated to provide maintenance or updates for the SOFTWARE. However, any maintenance or updates provided by POWWOW MEDIA (ADVERTISING SA) shall be covered by this Agreement.

DISTRIBUTION

You are hereby allowed to make as many copies of this SOFTWARE as you wish and distribute the software in its unmodified form via a website You are specifically prohibited from charging for use of or access to, or requesting donations, or bundling with any other software or hardware the SOFTWARE unless you obtain a custom license agreement from POWWOW MEDIA (ADVERTISING SA) You are not allowed to dsitribute the SOFTWARE on CD.

SHOULD YOU FAIL TO COMPLY WITH ANY OF THE ABOVE, YOUR USER RIGHTS ARE AUTOMATICALLY TERMINATED. THIS TERMINATION WILL BE IN ADDITION TO ANY CRIMINAL, CIVIL OR OTHER REMEDIES WHICH POWWOW MEDIA (ADVERTISING SA) MAY SEEK.

PLAYER REPRESENTATION AND WARRANTIES:

1. The Player is at least 18 years of age or has reached the legal age of maturity in his/her jurisdiction, whichever is greater.

2. Only one account per house hold is accepted. If a second account is created it will be closed and the bonuses and winnings may be cancelled. All promotions can only be claimed once per person, household, family, household address, email address,

3. One winner will be notified by email. The winner will be identified by the highest score before closing date of competition which is January 30th 2009 at 5pm. If two or more people have the same high score, the LATEST highest score will be deemed the winner. Final decision is final. No communication will be entered into.

4. Prize: The Prize for the Reindeer Games as posted on the POWWOW MEDIA (ADVERTISING SA) website is an iPod Nano (RRP $150). Colour of the Ipod Nano will be random and cannot be exchanged for another product or money. Prize will be collected by the Winner from Level 1/24 North Terrace, Adelaide SA 5000. If the Winner cannot collect the Prize personally, it will be sent by courier to an address within the Adelaide Metro area free of charge. If the Winner wishes the Prize to be sent to an address outside the Adelaide Metro area, the Winner will have to pay for postage and handling (POA).

5. The Player fully understands the rules of the games and the procedures involved in playing Reindeer Games through use of this software application.

6. The Player accepts all outcomes of game results as received in the client application from POWWOW MEDIA (ADVERTISING SA)’s game server. The Player fully accepts and agrees that POWWOW MEDIA (ADVERTISING SA)’s Winner generator software will determine the outcome of the Game.

Copying, redistribution or publication of any of the content or part of the software is strictly prohibited. Title, ownership and all intellectual property rights in the name "REINDEER GAMES" remain with POWWOW MEDIA (ADVERTISING SA), as the case may be.

By PLAYING THE GAME the player hereby ascertains that he/she has fully read and understood the above 'terms and conditions' and so agrees to be bound by them.
